These Terms of Service (“Terms”) govern your access to and use of the Swole Much Fun website and your purchase of our products. Please read them carefully.

Acceptance of terms

By accessing our site or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our site or purchase our products. We may update these Terms from time to time, and your continued use after changes take effect means you accept the updated Terms.

Products and pre-orders

All orders are offers to purchase and are accepted by us subject to product availability. We reserve the right to limit quantities, correct errors, or decline or cancel an order.

• Pre-orders: pre-ordered items ship from an upcoming production run. We will confirm an estimated ship date by email, and production timelines may shift. We will keep you informed of any significant changes.
• Pricing: prices are shown in U.S. dollars and may change at any time. The price that applies to your order is the price in effect when your order is placed and accepted.

Freight shipping

Our slides are large and heavy and typically ship by LTL (less-than-truckload) freight. Shipping rates vary by region and are calculated at checkout or confirmed before your order ships.

Risk of loss passes to you upon delivery. Please inspect your shipment carefully on arrival and note any visible damage on the delivery receipt before signing, then contact us right away so we can help.

Returns and warranty

Returns and warranty coverage are described on our Returns & Warranty page (/returns), which is incorporated into these Terms. Please review it for eligibility, time limits, and how to start a request.

Safety and assumption of risk

Inflatable water-slide products carry an inherent risk of injury. Water slides are slippery, involve sliding and water, and can result in serious injury if misused. By purchasing and using our products, you acknowledge and accept the following:

• Competent adult supervision is required at all times during setup and use.
• You must read and follow all setup, anchoring, water-pressure, age, weight, and safety instructions provided with the product.
• You voluntarily assume all risks of injury associated with the setup and use of the product, for yourself and anyone you permit to use it.
• Products are intended for recreational use only and must not be used in unsafe conditions, including high winds or on unsuitable surfaces.

Limitation of liability

To the fullest extent permitted by law, Swole Much Fun and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from the use or inability to use our products or site. To the extent liability cannot be excluded, our total liability is limited to the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Intellectual property

Our product designs are patent pending. The Swole Much Fun name, logo, branding, website, images, and other content are owned by Swole Much Fun and protected by intellectual property laws. You may not copy, reproduce, or use our content or marks without our prior written permission.

Governing law

These Terms are governed by the laws of the State of [TBD], without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or your use of our products will be subject to the jurisdiction of the courts located in that state.
